Terms of Service

By creating an account or using Hank, you agree to these Terms of Service and our Privacy Policy (available at hankquotes.com/privacy). If you do not agree, do not use Hank. These terms form a binding agreement between you and Hank. Capitalized terms used in these terms have the meanings given to them here or in our Privacy Policy.

Hank is a quoting and invoicing platform for solo tradespeople. You can use Hank to: • Create professional job quotes and invoices. • Deliver quotes to your customers via email or your phone's native SMS app. • Accept quote approvals online. • Convert approved quotes into invoices. • Maintain a customer list and a library of saved services. • Generate and download branded PDF quotes and invoices. • Use optional AI features (Voice to Quote, Snap to Quote) to build quotes from spoken descriptions or photos — Pro only. Hank is provided as a mobile app (iOS and Android) and a website (hankquotes.com), including a customer-facing quote viewer that does not require an account.

You need an account to use Hank. You are responsible for keeping your login credentials secure. Everything done under your account is your responsibility. If you believe your account has been accessed without your permission, email support@hankquotes.com immediately so we can help you secure it. You must be at least 16 years old to use Hank. If you are under the age of majority in your province or state, you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf. You must provide accurate information when creating your account and keep it current. You may not have more than one active account per business without our written permission.

Hank offers two tiers: • Free — 5 quotes per month, "Powered by Hank" branding on PDFs. No time limit and no expiry. • Pro — $19 USD per month or $159 USD per year. Unlimited quotes, no branding, Voice to Quote, Snap to Quote, quote analytics, scheduled sends, auto follow-ups, CSV import, custom PDF templates, and priority support. Payments are processed by Stripe, Inc. Stripe collects your card information directly; we never receive or store it. Paid subscriptions renew automatically at the end of each billing period. Your payment method will be charged on the same day each month or year until you cancel. You can cancel at any time from your account settings or by emailing support@hankquotes.com. Your plan remains active until the end of the current billing period and you will not be charged again. We do not offer refunds for partial billing periods except where required by law. If you believe you were charged in error, contact us at support@hankquotes.com within 30 days. Prices may change with at least 30 days' notice. If you do not agree with a price change, you may cancel before the new price takes effect. Continuing to use Hank after a price change becomes effective constitutes acceptance of the new price.

You may use Hank to run your own legitimate trade or service business. You may not: • Send spam, fraudulent quotes, or offensive or deceptive content. • Attempt to access another user's data or otherwise interfere with the service. • Reverse-engineer, decompile, scrape, or resell any part of Hank. • Use automated bots, scripts, or scrapers to interact with the service beyond the rate limits we publish or enforce. • Impersonate another person or business, including creating quotes under a name you do not have the right to use. • Send quotes for illegal goods or services. • Use Hank to stalk, harass, or defraud any person, including your customers. • Upload or transmit malicious code, viruses, or other harmful material. • Use the service in a way that violates export-control laws or any other applicable law. We may suspend or terminate accounts that violate these rules, with or without prior notice depending on the severity.

You own your data. Your quotes, customer records, service library, business information, and uploaded files belong to you. By using Hank, you give us the limited rights necessary to store, process, transmit, and display your data so we can provide the service — for example, to generate PDFs, send emails, and deliver quotes through your phone's native messaging app. We will never sell your data. We will not use your data for advertising. We will not use your data, or your customers' data, to train any AI model ourselves; the third-party AI providers we route through for optional features are also bound by standard API terms that prohibit training on your data (see "AI Features" for details). The customer records you enter in Hank are your records. You are the controller of that information under applicable data-protection law, and Hank acts as the processor on your instructions. This means: • You must have a lawful basis to hold and contact your customers — typically an existing business relationship or their consent. • You are responsible for complying with CAN-SPAM (United States), CASL (Canada's Anti-Spam Legislation), GDPR (European Economic Area), UK GDPR, PIPEDA (Canada), and any other law that applies to your communications. • You must not use Hank to send unsolicited commercial messages to people who have not agreed to receive them. • If one of your customers contacts Hank directly about their data, we will refer them back to you as the controller and, where appropriate, notify you of the request.

Hank Pro includes two optional AI features that you can choose to use: • Voice to Quote — records your voice, transcribes it using OpenAI (Whisper), and extracts structured line items using Anthropic (Claude). • Snap to Quote — takes a photo and extracts structured line items from it using Anthropic (Claude). These features are subject to a monthly fair-use cap of 200 AI calls per Pro user per month. If you hit the cap, the feature pauses until the start of the next calendar month. AI output is generated by a third-party model and may contain errors. You must review and edit every AI-assisted quote before sending. Hank is not liable for errors in line items, prices, or other content produced with AI assistance. You bear final responsibility for every quote you send. Your audio recordings and images are sent to the AI providers for a single extraction pass. Hank discards the original audio or image as soon as we receive the response — we do not store or log it. Under OpenAI's and Anthropic's standard API terms, which apply to Hank's usage, your data is not used to train their models. Both providers may retain API inputs and outputs for up to 30 days for abuse monitoring and safety review, after which the data is automatically deleted. Their own privacy policies apply to any processing they perform; see openai.com/policies/privacy-policy and anthropic.com/legal/privacy.

Your quote and customer data remains in Hank for as long as your account is active. Generated PDF files are stored for 90 days and then automatically deleted — your quote data itself remains available and PDFs can be regenerated at any time. AI audio recordings and images are not retained by Hank at all; they are discarded immediately after processing. If you delete your account, your data is permanently removed from our production databases within 30 days. Encrypted backups containing your data are automatically overwritten within 90 days after deletion. Billing records are retained for 7 years as required by tax and accounting law, stripped of non-essential personal details.

When you send a quote via email, Hank delivers it through Resend, our email service provider. We take reasonable steps to ensure delivery, but we cannot guarantee that every email will arrive — delivery depends on your customer's email provider, spam filters, and configuration. You are responsible for verifying receipt where it matters. When you send a quote via text, Hank opens your phone's native messaging app with the message pre-filled. The SMS is sent directly from your device and your phone number. No third-party SMS service is involved and no customer data passes through our servers for text delivery. Quote sends count toward your monthly Free-tier quota regardless of whether the message was successfully delivered. By using Hank to send emails or SMS messages, you confirm you have your customer's consent to contact them. You must comply with CAN-SPAM, CASL, GDPR, and any other applicable law. You must not use Hank to send unsolicited commercial messages.

When you send a quote, your customer receives a link to view and approve it at hankquotes.com/q/[unique-id]. This page displays the quote details you created, including your business name, logo, and contact information. Customers do not need an account. You are responsible for the accuracy of the information displayed on your quotes and invoices. Hank does not verify the truth of quote content.

The Hank app, website, logo, design, icons, copy, and code are owned by Hank and protected by copyright, trademark, and other intellectual-property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use Hank for its intended purpose for as long as you comply with these terms. You may not: • Copy, modify, translate, or create derivative works from any part of the Hank platform. • Remove, alter, or obscure the "Powered by Hank" branding on Free-tier PDFs. • Use the Hank name, logo, or any of our trademarks without our prior written permission, except for factual references such as "I use Hank to send my quotes." • Register confusingly similar domain names, business names, or trademarks. "Hank" and "hankquotes.com" are our trademarks.

You agree to indemnify and hold Hank harmless from any claim, loss, damage, liability, cost, or expense (including reasonable legal fees) arising from: • Your misuse of the service; • Your violation of these terms or any law; • Your violation of another person's rights (including your customers' privacy rights); or • Content you upload, transmit, or send through Hank. Hank agrees to defend and hold you harmless from third-party claims arising from Hank's gross negligence or willful misconduct in providing the service. This indemnification is mutual — neither party bears all the risk.

Hank is provided "as is" and "as available." We work hard to keep things running smoothly but we do not warrant that the service will be uninterrupted, error-free, or meet your specific needs. To the maximum extent permitted by applicable law, Hank is not liable for: • Lost revenue, missed jobs, or any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. • Errors or inaccuracies in quotes you create, including quotes generated with AI assistance. • Failed email or SMS delivery. • Actions taken by your customers based on quote content. • Outages of third-party services (Supabase, Stripe, Resend, OpenAI, Anthropic, Vercel, or your mobile carrier). Our total aggregate liability to you for any claim is limited to the greater of (a) the amount you have paid us in the 12 months before the event giving rise to the claim, or (b) $100 USD. Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, death or personal injury caused by our negligence, or anything else that cannot be excluded or limited under applicable law.

You can delete your account at any time from Settings or by emailing support@hankquotes.com. Before deletion, you can export your data from the app. We may suspend or terminate your account if you: • Violate these terms or our Acceptable Use policy; • Abuse the service or other users; • Fail to pay for an active subscription; • Use Hank for illegal purposes; or • Pose a security risk to the service. Where possible and safe to do so, we will give you at least 30 days' notice by email and a reasonable opportunity to export your data. If termination is due to abuse or illegal activity requiring immediate action, we may terminate without notice. The following sections survive termination: Your Customers' Data, Data Retention, Hank's Intellectual Property, Indemnification, Limitation of Liability, Dispute Resolution, and General.

If you have a dispute with Hank, please contact us first at support@hankquotes.com. We will try to resolve it informally within 30 days of receiving your notice. If we cannot resolve the dispute informally, either party may pursue resolution through the courts. For users in Canada, these terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Courts of competent jurisdiction in Ontario will have exclusive jurisdiction over any disputes, subject to consumer-protection exceptions below. For users outside Canada, these terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Nothing in this section limits your right to bring a claim in small-claims court, or limits any rights that cannot be waived under applicable consumer-protection laws in your jurisdiction (including the Consumer Protection Act of Quebec and equivalent laws in your state or country).

Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, power outages, internet or cloud-provider disruptions, pandemics, government actions, labor disputes, or acts of war. If a force majeure event continues for more than 60 days, either party may terminate this agreement with written notice.

We may update these terms from time to time. When we make material changes, we will notify you via email or in-app notification at least 14 days before they take effect. The effective date at the top of this page always reflects the most recent revision. Continued use of Hank after changes take effect means you accept the updated terms. If you do not accept the updated terms, you must stop using Hank and may cancel any active subscription.

Severability. If any part of these terms is found to be unenforceable by a court, the rest of the terms remain in full effect. Entire agreement. These terms, together with our Privacy Policy and any Data Processing Addendum we enter with you, are the entire agreement between you and Hank regarding the service and replace any prior agreements. Waiver. Our failure to enforce any right or provision does not waive that right. Assignment. You may not transfer your rights or obligations under these terms without our consent. Hank may assign its rights under these terms in connection with a merger, acquisition, corporate reorganization, or sale of substantially all assets. No agency. Nothing in these terms creates an agency, partnership, joint venture, or employment relationship between you and Hank. Language. These terms are drafted in English. Translations, where provided, are for convenience only; the English version controls in the event of conflict.
